On September 24, 2019, the U.S. Department of Labor (DOL) announced a increasing the minimum salary threshold for exemption from overtime under the federal Fair Labor Standards Act from $23,660 ($455 per week) to $35,568 ($684 per week).Â
The new rule takes effect January 1, 2020.  Â
An increase to the minimum salary threshold for overtime exemption means that employees who are currently exempt from overtime (and who are not teachers, doctors, lawyers) and whose salary is less than $684 per week will become eligible for overtime unless their salaries are increased to a minimum of $684 per week.Â
This change impacts a few hundred staff and research positions at CU Boulder. However, this change does NOT impact employees whose majority duties involve teaching, tutoring or lecturing, such as faculty, student teaching assistants, coaches and assistant coaches.Â
CU Boulder Human Resources is currently reviewing the overtime exemption status of employees on campus to confirm which employees continue to be exempt from overtime under the new DOL rules and which employees require further analysis. Once this review is complete, CU Boulder HR will reach out to campus departments with impacted employees to discuss options available for complying with these changes.
